Hire terms
Definitions: “Hirer” means any person who requests LCtechnical to hire equipment, goods or services including its employees and agents. “Supplier” means LCtechnical including its employees, contractors and agents.
- The Hirer may accept the costs, terms and conditions by signing and returning the copy of this document, accepting the hired goods, or continuing to give instructions to the Supplier regarding this matter. Your acceptance of this agreement of this will be inferred by your conduct if, after having received this agreement, you continue to instruct the Supplier with respect this matter. This Agreement is entered into and will be binding on the Supplier and Hirer upon the Hirer's acceptance of the offer.
- The Hirer shall be responsible for any loss of damage arising, harm, personal injury or death (including loss of opportunity); or damage to property whether direct indirect, special or consequential caused by the hired equipment or goods whilst the Hirer is in possession.
- The Hirer is responsible for all the hired equipment & goods and any damage, theft or loss incurred during the period of hire. Any theft of substantial value must be reported to the police. Any damage repair or replacement costs to hired goods will be at the Hirer’s expense.
- Any shortages or malfunction of the equipment or goods must be notified by the Hirer to the Supplier in writing within 24 hours of delivery.
- The Hirer agrees to indemnify and agree to keep indemnified the Supplier, it’s Directors, officers, employees and contractors against all claims made or brought the Supplier arising from any act or omission by the Hirer, the Hirer’s representatives, partners, agents and all third party contactor’s or suppliers in connection with the services provided, use or operation of the equipment or goods hired.
- The Supplier reserves the right to withdraw the equipment, goods or services if the Hirer or a third party's plans breach our policies regarding safe work practices for our employees or any applicable OH&S standards.
- The Supplier reserves the right to terminate the services provided and recover the hired equipment & goods at any time.
- The Supplier reserves the right to withdraw the equipment, goods or services if the weather, access or location conditions are poor which may arise to harm, personal injury, damage to property, loss or damage to hired equipment or goods.
- The Supplier reserves the right to substitute equipment, goods or consumables due to seasonal variations affecting availability of stock that is of equal value.
- The Hirer shall not use the equipment or goods for any outdoor performances, use other than the intended purpose for the equipment or goods, or use at other purpose than the event and venue indicated on the agreement.
- The Hirer is solely responsible for the safe use of the equipment & goods and compliance with all the OHS and other statutory requirements.
- It is the responsibility of the Hirer to hold their own appropriate insurances. The Supplier policies of insurance apply on in relation to the provision of services and do not provide any insurance cover for the Hirer or the event.
- A deposit may be required when design, prototyping and/or research is required before an accurate estimate can be provided. 100% of the deposit will be deducted from the final invoice, but is non-refundable if the design requirements change.
- In the event that, after prototyping, the supplier cannot meet the show requirements. The deposit will be refunded, minus the cost of materials and a reduced labour rate.
